DROWNING VICTIM'S MOTHER SUES APARTMENT COMPLEX
Plain Dealer, The (Cleveland, OH) - March 19, 1992
Edition: LATE / SPORTSSection: METROPage: 1BColumn: Lake / Geauga Watch
The mother of a 5-year-old boy who drowned in an apartment swimming pool last year has sued the owners and operators of the Concord Township complex where the death occurred.
According to the lawsuit filed yesterday in Lake County Common Pleas Court, the swimming pool at the Concord Hall Manor Apartments on Johnnycake Ridge Rd. was unsafe and improperly maintained.
On April 25, 1991, Erik L. Portzer, of Kirtland, was visiting a friend, Matthew Thompson, 8, who lived at the complex. Erik and Matthew climbed over a 4-foot chain-link fence and later were found in the partially drained pool. Erik died and Matthew suffered brain damage.
Erik's mother, Linda L., has sued I.P.C. Land Development Co., in Cleveland; Concord Hall General Partnership, in North Canton; Sequoia Realty Corp., in Mentor-on-the-Lake; and Sequoia Management Co., in Columbus. The suit claims they owned, occupied, controlled and operated the complex.
The suit seeks an undetermined amount of damages for the alleged negligence that caused Erik's death and for the mental and emotional distress suffered by his mother and father, Ralph E.
None of the defendants could be reached for comment.
CASE OF BOY INJURED IN POOL TRANSFERRED
Plain Dealer, The (Cleveland, OH) - January 28, 1993

The case of a 6-year-old boy who suffered brain damage in a Concord Township pool will be heard in Lake County Common Pleas Court.
Matthew J. Thompson and his parents, Ernest and Rena Thompson, filed a lawsuit in June in Cuyahoga County against the Concord Hall Manor Apartments and its owners. But the case was transferred yesterday to Lake County because that's where Matthew's accident occurred.
Matthew, now 8, lived at the apartments on Old Johnnycake Rd. in April 1991 and was playing with a friend, 5-year-old Erik Portzer of Kirtland. The pair somehow got over the four-foot fence of the swimming pool and entered the water. Authorities believe Erik may have entered first, and Matthew was trying to save him.
Erik died in the drowning, and Matthew survived with severe brain damage "which has rendered him permanently and totally disabled," according to the lawsuit. Erik's mother, Linda L. Portzer, has a similar lawsuit pending in Lake County.
